Sweepstakes Description

The Sweepstakes involves SQUARE ENIX MEMBERS participation online.  Members can visit the DISSIDIA page and enter the WHAT WILL YOU FIGHT FOR? Campaign by going into the "Allegiance" section and choosing a side – "Cosmos" or "Chaos."  Once an Allegiance is chosen, Members can spread the word by recruiting friends via email invitations* to join their Allegiance.  The Allegiance with the most participants will win.

All participants will receive an avatar virtual item and 10 Members Points. Everyone on the winning Allegiance will receive an additional 20 Members Points and will be entered into a sweepstakes to win one of the following prize packages:

Grand Prize:	One (1) canvas print depicting the characters of the winning (i.e., Cosmos or Chaos) Allegiance + DISSIDIA FINAL FANTASY PSP® (PlayStation®Portable) system bundle + Preorder item pack (1 winner)
First Prizes:	DISSIDIA FINAL FANTASY PSP bundle + Preorder item pack (4 winners)

Summary

2. ENTRY REQUIREMENTS; ELIGIBILITY
1. Go to (http://member.square-enix.com/na/) for information regarding the Sweepstakes. Must be a Member to enter.  If you don’t have an account, you can register for a free MEMBERS Account.
2. Entrants must be 13 years or older at the time of entry.
3. This is an Internet-only Sweepstakes. All entries must be submitted via the SQUARE ENIX MEMBERS website.
4. Entrant (or if entrant is a Minor under the age of 18, entrant’s parent or legal guardian) must agree to these official rules in order to submit and receive any prize.
5. Entrant must be a legal resident of the U.S. or Canada and must be 13 years old or older.
6. All contact information provided when submitting entrant’s entry will be used as the contact information for all purposes.  Any missing information may disqualify the entry.  Square Enix may use winning entrant’s name, age, and other information for purpose of advertising and publicity only. 
7. Entrants must comply with all applicable laws, including anti-spam laws.  Square Enix reserves the right to disqualify any entrant whom it deems in violation of this provision.


3. SELECTION
1. Go to the DISSIDIA features page and click on the "Allegiance" section.
2. Choose an Allegiance, "Cosmos" or "Chaos."  Once an Allegiance is chosen, it cannot be changed.
3. The Allegiance with the most Members by the end date will be declared the "Winning Allegiance."
4. All Members on the Winning Allegiance will be entered into a sweepstakes to be eligible to win one of five (5) prizes.
5. Sweepstakes starts August 7, 2009 and ends September 30, 2009; all entries must be received by September 30, 2009.
6. Winning Allegiance will be announced October 7, 2009.
7. Prize winners will be announced October 7, 2009.


4. RULES
1. You may not use any software program or tool to automate the sign-up process.
2. You may not "invite yourself" by entering an additional email address owned or controlled by you. 
3. You may not create multiple memberships to the MEMBERS Site.
4. Square Enix reserves the right to disqualify any entrants whom it deems in violation of these rules.


5. PRIZES AND PUBLICITY
1. All participants will receive an avatar item for use on the MEMBERS Site and 10 Members Points. 
2. Each participant on the Winning Allegiance will receive an additional 20 Members Points for a total of 30 Members Points each, and will be entered into the Sweepstakes for a chance to win one of five (5) prizes .
3. One (1) Grand Prize winner and four (4) First Prize winners will be selected at random from members of the winning Allegiance.

4. All Grand Prize and First Prize winners will be required to submit an Affidavit of Eligibility to Square Enix within thirty (30) days of notification of winning status.  The form will be provided to entrant at the time of notification of winning status.  Minors will be required to obtain a signature from their parent or guardian.  Failure to submit this signed form will result in a disqualification of the entrant and a forfeiture of any prize.
5. Square Enix may use winning entrants’ name, age, and other information for purpose of advertising and publicity only in conjunction with the Sweepstakes.  All nicknames used at the time of submission will appear along with the announcement of the winners.

Official Sweepstakes Rules

1. ELIGIBILITY
   NO PURCHASE NECESSARY TO ENTER OR WIN.  Offer void where prohibited BY LAW.  ODDS OF WINNING DEPEND ON THE NUMBER OF VALID ENTRIES RECEIVED.  SWEEPSTAKES OPEN ONLY TO REGISTERED MEMBERS OF SQUARE ENIX MEMBERS SITE (NORTH AMERICA), WHO ARE LEGAL U.S. OR CANADA RESIDENTS, WHO ARE 13 YEARS OLD OR OLDER, AND WHO ARE LOCATED IN THE U.S. OR CANADA AT THE TIME OF ENTRY.  To be eligible to win a prize, entries must be completed and received by SQUARE ENIX, INC. (“Sponsor”) in compliance with these rules and all other instructions of Sponsor.  Directors, officers, and employees of Sponsor, its parent company, and their respective parent companies, subsidiaries, and other affiliated companies, and agents, professional advisors, advertising, and promotional agents of the same, including any immediate family members of the same, are not eligible to win any prizes.  The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.


2. SWEEPSTAKES PERIOD
   The Sweepstakes period is from August 7, 2009 at 12:00 p.m. (Pacific Time) to September 30, 2009 at 11:59 a.m. (Pacific Time) (the “Deadline”). All entries must be received by the Deadline to be eligible to win a prize. Square Enix will, in its sole discretion, determine the valid and official entry time, should any discrepancies of time occur.


3. PRIZES
   Eligible entrants will be eligible to win the prizes described in the summary above.
   
   Odds of winning a prize depend on the number of eligible entries received. ALL FEDERAL, STATE, AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.  Prize winners will be announced on or about October 7, 2009.  Prizes will be awarded after winners are announced.  Prizes are not transferable.  No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Square Enix reserves the right to substitute a prize of equal or greater value for any prize listed in the table above.  Prizes won by a Minor (as determined by the laws of the entrant’s state of residence) will be awarded to a parent or legal guardian on the Minor’s behalf.  Actual retail value of prizes may vary due to market conditions at the time prizes are awarded.  All prizes are awarded “AS IS” and WITHOUT ANY WARRANTY OF ANY KIND, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.
   
   IN NO EVENT WILL THE CONTEST WINNERS BE ENTITLED TO ANY FEE, ROYALTY, OR OTHER COMPENSATION OF ANY KIND AS A RESULT OF THE CONTEST.  BY ENTERING, EACH CONTESTANT (AND, IF A MINOR, HIS OR HER PARENT OR LEGAL GUARDIAN) IRREVOCABLY WAIVES ANY RIGHT TO COMPENSATION FOR SQUARE ENIX’S USE OF SUCH CONTESTANT’S ENTRY MATERIALS (AS DEFINED BELOW) IN ACCORDANCE WITH THESE RULES.

   BY ENTERING THE SWEEPSTAKES, YOU (AND, IF YOU ARE A MINOR, YOUR PARENTS OR LEGAL GUARDIANS) RELEASE SPONSOR, SQUARE ENIX, INC., ITS PARENT COMPANY, AND ANY OF THEIR RESPECTIVE PARENT COMPANIES, SUBSIDIARIES, AND OTHER AFFILIATED COMPANIES, AND THE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS OF THE SAME (COLLECTIVELY, THE “RELEASED PARTIES”), FROM ANY LIABILITY WHATSOEVER, AND WAIVE ANY AND ALL CAUSES OF ACTION, RELATED TO ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE SWEEPSTAKES OR DELIVERY, MISDELIVERY, ACCEPTANCE, POSSESSION, USE OF, OR INABILITY TO USE ANY PRIZE (INCLUDING, WITHOUT LIMITATION, CLAIMS, COSTS, INJURIES, LOSSES, AND DAMAGES RELATED TO PERSONAL INJURIES, DEATH, DAMAGE TO OR DESTRUCTION OF PROPERTY, RIGHTS OF PUBLICITY OR PRIVACY, DEFAMATION OR PORTRAYAL IN A FALSE LIGHT (WHETHER INTENTIONAL OR UNINTENTIONAL AND WHETHER UNDER A THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), WARRANTY, OR OTHER THEORY).
   
   
5. USE OF WINNER’S NAME, LIKENESS, ETC.
   Except where prohibited by law, entry into the Sweepstakes constitutes permission to use the winners’ names, nicknames, addresses, likenesses, and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, winners may be required to provide written consent to the use of their name, address, likeness, and/or prize information, without limitation, for promotional purposes without further permission or compensation. The use of an entry, commentary regarding an entry, timing and location of any announcement regarding the Sweepstakes or any entry, and all other matters concerning the Sweepstakes will be decided upon by Square Enix in its sole discretion. 6. AFFIDAVIT & RELEASE
   As a condition of being awarded any prize, winners (and if winner is a Minor, winner’s parent or legal guardian) will be required to execute and deliver to Square Enix a signed Affidavit of Eligibility and acceptance of these Official Sweepstakes Rules and release of liability.
   
   
7. WINNERS LIST; RULES REQUEST
   A list showing the Winner, which will include his or her registered name and state of residence, will be posted on the Square Enix Members site at member.square-enix.com/na/ on or about October 7, 2009. Or, to obtain an official list showing the Winner, send a self-addressed business-sized envelope to Square Enix, Inc., 999 N. Sepulveda Blvd., 3rd Floor, El Segundo, CA 90245, Attn: DISSIDIA FINAL FANTASY WWYFF Campaign. An official announcement of the Winner will not be available until the announcement is posted on SQUARE ENIX, INC.’s Web site on or about October 7, 2009.

9. MISCELLANEOUS
   The Sweepstakes and these Official Sweepstakes Rules will be governed, construed, and interpreted under the laws of the United States. Entrants agree to be bound by these Official Sweepstakes Rules and by the decisions of Square Enix, which are final and binding in all respects. Square Enix reserves the right to change these Official Sweepstakes Rules at any time, in its sole discretion, and to suspend or cancel the Sweepstakes or any entrant’s participation in the Sweepstakes should viruses, bugs, unauthorized human intervention, or other causes beyond Square Enix’s control affect the administration, security, or proper play of the Sweepstakes or Square Enix otherwise becomes, as determined in its sole discretion, incapable of running the Sweepstakes as planned. Entrants who violate these Official Sweepstakes Rules, tamper with the operation of the Sweepstakes, or engage in any conduct that is detrimental or unfair to Square Enix, the Sweepstakes, or any other entrant, in each case as determined in Square Enix’s sole discretion, are subject to disqualification from entry into the Sweepstakes. Square Enix reserves the right to disqualify persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Sweepstakes. 10. FORCE MAJEURE
    Square Enix reserves the right to change, suspend, or cancel the Sweepstakes if, in Square Enix’s sole discretion, intervening circumstances warrant such change, suspension, or cancellation. Intervening circumstances include, but are not limited to, strikes, labor disputes, war, insurrections, revolutions, terrorism, riots or other civil disturbances, earthquakes, fires, floods, or other natural disasters, governmental restrictions, embargoes or other exercises of governmental authority, unavailability of supplies, components, or material, or any other cause beyond Square Enix’s control.
    
    
11. DISCLAIMER
    Square Enix, all participating sponsors, and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees, and agencies will not be responsible for: (a) any late, lost, misrouted, garbled, or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communications related malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses, or damages caused by events beyond the control of Square Enix or other participating sponsors; or (d) any printing or typographical errors in any materials associated with the Sweepstakes.
